This Policy covers only the Site identified above, and does not apply to information which you may send us by other means. Other Hoshino USA sites and other online locations may have their own privacy policies, and you should consult those accordingly.
This Policy is effective as of: November 6, 2018.
The Site is meant for individuals within the United States. Hoshino USA only knowingly collects information from individuals within the United States. If you provide information to Hoshino USA on or through the Site from outside of the United States, you do so at your own risk. If you are outside of the United States, you are responsible for complying with any local laws regarding your use of the Site, and any related data collection. You also agree and acknowledge that by providing any information through the Site, including PII, that such information will be transmitted to, and stored in, the United States.
Hoshino USA reserves the right to update or amend this Policy at any time. Amendments will be posted below for a period of thirty (30) days and will be effective when posted. The changes will also be immediately incorporated into this Policy.
Your continued use of the Site following the posting of any amendment, modification or change to this Policy shall constitute your acceptance of the changes. If any of the changes are unacceptable to you, you should cease using the Site.
Collection and Use of Information
Personally identifiable information ("PII") is generally defined as information that may be able to identify you, information that could reasonably be linked to you, or information that may be used to get access to your online accounts. PII could include, but is not limited to, name, address, phone number, email address and other online identifiers, username and password (or security question and answer), payment information, professional or employment-related information, browsing or search history, personal preferences and characteristics, etc.
There are areas on the Site where you may be asked to provide Hoshino USA with PII, or where such PII or other information may be collected from you in an automated manner. For example, PII (and other related information) such as name, mailing and/or shipping address(es), phone number, email address, username and password, credit/debit card number or other payment information, your personal preferences and level of musical expertise may be collected from you when you:
- set up an account on the Site;
- create a username and password;
- register for Ibanez clinics or events;
- sign up for Ibanez online video lessons;
- use the "Find an Authorized Ibanez Dealer" Site page;
- contact Hoshino USA with questions or comments;
- participate in surveys, questionnaires, sweepstakes or contests;
- sign up for Plugged In, the Ibanez Official Newsletter;
- order and pay for products and services through the Site; and/or
- complete and submit the Site's warranty registration form.
If you use the Site on your phone, tablet or other mobile device, you may allow the Site to find and track the location of your device. Your device should seek your permission before collecting and tracking your location.
Hoshino USA may use your PII and other information to:
- maintain proper business records and other relevant records;
- provide ongoing technical support related to your use of the Site;
- administer and secure your account;
- locate authorized Ibanez dealers near you:
- contact you if there are issues with content that you uploaded or posted through the Site;
- process payment information when you order a product or service through the Site;
- ship to you products or services that you order through the Site;
- send you marketing communications based on your order history and preferences;
- schedule and administer clinics and events;
- respond to questions or comments;
- communicate with you regarding additional uses of your PII beyond the scope of this list;
- deliver content and services through the Site;
- process and catalog responses to surveys or questionnaires;
- enter you in contests and other promotions;
- send you Ibanez newsletters and other updates;
- process your warranty registration;
- improve the content and general administration of the Site;
- perform internal Site operations (e.g., fraud prevention);
- troubleshoot software issues and operational problems with the Site;
- conduct data analysis and testing; and/or
- monitor Site usage.
Hoshino USA collects certain information that is less likely to personally identify you in a number of ways, including tracking your activities through your IP address, computer settings or most-recently visited URL, by using data-tracking software which tells us what parts of the Site you have browsed. We may use this information to tell you about products or services which we feel may be of interest to you, and we may also share this information with other parties from whom we believe you may want to receive information. Any information about you, whether obtained through collection or tracking, may be used to contact you again either by online electronic communication (such as e-mail), or by regular mail or telephone.
We will also be collecting and tracking information about activities on our Site on an aggregate (i.e., group) basis, where we will not know or keep track of precisely who you are, so that we may keep track of what users may be interested in, to help us in our marketing efforts.
We also collect passive information for purposes such as testing and improving a user's experience at the site and for compiling broad aggregate demographic data and related usage data for Hoshino USA's internal purposes. The types of passive information include, but are not limited to, your IP address, which type of browser you are using, where you go on our Site and how long you stay on any part of our Site. We may also track how you interact with the Site by assigning a random string of numbers and characters to your session. Passive information does not identify you to Hoshino USA by name, and Hoshino USA does not link your IP address to your PII.
By providing to Hoshino USA the PII and other information referenced above, you agree that Hoshino USA may use the PII and other information in accordance with the terms of this Policy.
Sharing of PII and Other Information
Except as noted herein, Hoshino USA does not sell or share your PII with any person or entity outside of Hoshino USA.
Hoshino USA may share certain portions of PII and other information with its vendors in order to make the Site and Site-related services function properly. This may include sharing PII with:
- Stripe, our credit card processing entity, in order to process any credit/debit card payments made through the Site;
- our shipping providers to send you products that you order through the Site; and/or
- our email vendors to send you newsletters to which you have subscribed.
Hoshino USA will disclose your PII or other information if it reasonably believes it is required to do so by law or in cooperation with a governmental or law enforcement investigation. Hoshino USA may also share PII or other information in order to avoid imminent physical harm to any person or harm to any Hoshino USA property.
Hoshino USA may share your PII with a third party if Hoshino USA's ownership status changes, such as if Hoshino USA is acquired or if Hoshino USA acquires another entity.
Other than what is referenced above, the PII and other data collected from you is not shared with nor sold to any person or entity outside of Hoshino USA.
Review of Collected PII/Other Choices
In connection with Hoshino USA's collection and use of your PII, you have the rights:
- to request details on the specific pieces of PII Hoshino USA has collected about you;
- to opt-out of any sale of your PII;
- to request that Hoshino USA delete PII it has collected about you; and
- to not be discriminated against, in terms of the services and prices offered on or through the Site, because you exercised these rights regarding the collection and use of your PII.
If you would like to review, edit, or delete any of the PII that Hoshino USA collected from you, or if you would like to exercise these rights in any other way, please contact Hoshino USA at email@example.com. Please note that Hoshino USA will do its best to accommodate your request, but Hoshino USA cannot guarantee it can remove all PII from the specified uses. Therefore, please be as specific as possible in your request. If the request relates to information that Hoshino USA needs to make the Site function properly for you, you may not be able to use the Site properly moving forward.
Hoshino USA reserves the right to maintain proper business records as required by law, or for otherwise legitimate business purposes to the extent permitted by law, even if such records contain your PII.

Hoshino USA does not knowingly collect any information from minors, nor is the Site directed at or intended for minors. If a minor uploads/posts information to the Site that is publicly available, and the minor subsequently wants that same information deleted, the minor has a right to request that such information be removed from public viewing. Minors who wish to request the removal of their information should submit their request to email@example.com. Any removal of content by Hoshino USA does not ensure or guarantee complete or comprehensive removal of the content in all places. The content may have been shared or reposted by other parties, or federal or state law may require maintenance of the content or information.
Response to "Do Not Track" Requests/Signals
Hoshino USA does not recognize or process "do not track" or similar technical requests.
Third parties that may directly collect information through the Site could respond differently than Hoshino USA to "do not track" requests, so you should consult the applicable privacy policies of those third parties for that information.
Data Security and Retention
The Site uses, implements and maintains industry standard technological security measures that are reasonably designed to help secure your non-public PII from loss, misuse, unauthorized access, alteration and/or disclosure, both in storage and in transmission. Hoshino USA protects PII by utilizing both online and offline security methods including, but not limited to, the use of SSL encryption, firewalls, passwords and restricted physical access to the places where your non-public PII is stored. Our staff is trained to comply with our security procedures, and our security procedures are regularly reviewed and revised, if necessary.
While Hoshino USA takes the issue of protecting your PII seriously, you should exercise discretion in what information you disclose and/or transmit on or through the Site. There is no such thing as "perfect security" on the Internet. Hoshino USA cannot guarantee that information sent over the Internet is fully secure. as the transmitted information may be intercepted by others before it reaches Hoshino USA. If you are concerned about sending information to Hoshino USA over the Internet, please send the information by mail or call us to make other arrangements. Hoshino USA is not responsible for the security of information sent over the Internet.
Hoshino USA retains collected information for a reasonable amount of time in order to fulfill the stated purpose for why the information was collected. Hoshino USA will also retain collected information connected to business records for periods of time required by law. If Hoshino USA determines that collected information is no longer needed, it will delete such information. Our collection times will be consistent with applicable law. Hoshino USA will maintain a membership list that includes some PII.
The Site is intended for individuals 18 years of age and older located in the United States.
The Site is not directed at, marketed to, nor intended for, children under 13 years of age. Hoshino USA does not knowingly collect any information, including PII, from children under 13 years of age. If Hoshino USA learns that any information was provided through the Site by a person younger than 13 years of age, Hoshino USA will delete the information immediately.
Hoshino USA will not use a minor's PII to market or advertise certain products or services deemed harmful to children. Hoshino USA also will not disclose any minor's PII if it has actual knowledge that the minor's PII will be used for the purpose of marketing or advertising harmful products or services.
Hoshino USA may also allow interaction between the Site and other sites or mobile applications such as Facebook or other social media providers. This may include the "Like" button or other plugins available through the Site that allow you to share information with persons outside of the Site. Please consult the privacy policies of those third party providers before using them to make sure you are comfortable with the level of sharing.
